RERA Disputes & Advisory in Delhi

RERA Disputes & Advisory in Delhi

The Real Estate (Regulation and Development) Act, 2016 gives Delhi property buyers powerful rights against builders who delay possession, deliver defective construction, or misrepresent project details. RERA Delhi, the state regulatory authority, can order builders to deliver possession, pay compensation for delay, and refund the full amount with interest if a project is not completed. The challenge is knowing which complaints fall within RERA’s jurisdiction, how to calculate compensation correctly, and how to enforce an order a builder refuses to comply with. Y&A Legal represents homebuyers and investors before RERA Delhi and, where necessary, before the Appellate Tribunal and Delhi High Court for enforcement.

How We Help

Possession Delay Complaints

If your builder has not delivered possession by the date stated in the builder-buyer agreement, RERA gives you the right to either remain in the project and claim compensation for every month of delay, or exit entirely and receive a full refund with interest at the RERA-prescribed rate. We file possession delay complaints before RERA Delhi, calculate the compensation or refund amount, and pursue the matter through to an enforceable order.

Builder Refund & Compensation Claims

If you want to exit a delayed or defective project, you are entitled under RERA to a full refund of all amounts paid, with interest at the rate specified by the state government, from the date of each payment. We calculate the total refund due, file the complaint before RERA Delhi, and enforce the order against the builder’s registered properties if the builder does not voluntarily comply.

Defective Construction Complaints

RERA Section 14 gives buyers a five-year warranty against structural defects, if a defect appears within five years of possession, the builder must repair it free of charge. If the builder refuses, we file a complaint before RERA Delhi for rectification. For major defects that affect habitability or safety, we also assess whether a compensation claim is available in addition to rectification.

RERA Advisory for Buyers & Developers

Before you sign a builder-buyer agreement, we review the RERA registration certificate for the project, verify that the project details match the registration, and advise on which clauses in the agreement need to be negotiated. For developers, we advise on RERA registration obligations, mandatory disclosure requirements, and the implications of project amendments on existing registrations.

Why Clients Choose Y&A Legal for RERA Disputes in Delhi

RERA Delhi has adjudicated thousands of complaints since it became operational, and the strength of a complaint depends on how it is framed from the beginning. A complaint that correctly identifies the delay period, calculates compensation on the right formula, and anticipates the builder’s defences is far more likely to produce a clean, enforceable order. We have handled RERA complaints across the range of Delhi builder disputes, from large townships with hundreds of buyers to single-flat purchasers dealing with a small developer.

Getting a RERA order is only half the battle, enforcing it against a builder who refuses to pay or hand over possession is the other half. RERA orders can be enforced through the RERA Execution Tribunal and, where necessary, through contempt proceedings before the Delhi High Court. We advise from the start on the best enforcement strategy, including whether the builder has assets that can be attached to satisfy the order.

Our RERA clients have typically paid 80–100% of the property value and are waiting years for possession that was promised within 2–3 years. Many have been told by the builder that delays are normal and that no compensation is payable. RERA clearly entitles you to compensation, and the delay in filing a complaint does not extinguish your right, you can file even after possession is eventually delivered to claim compensation for the entire delay period.

Frequently Asked Questions

What is RERA Delhi and how does it protect homebuyers?

RERA Delhi is the state real estate regulatory authority established under the Real Estate (Regulation and Development) Act, 2016. It requires all qualifying real estate projects to be registered, obliges builders to disclose project details publicly, and gives buyers the right to compensation for delays, refunds for project failures, and warranty claims for construction defects. Complaints are adjudicated by the authority, with appeals to the Appellate Tribunal and thereafter the Delhi High Court.

My builder has delayed possession by two years, can I file a RERA complaint?

Yes, and you can do so without giving up possession, you can simultaneously claim compensation for the delay period while remaining in the project. Under RERA, the builder is liable for interest at the rate prescribed by RERA Delhi for every month of delay from the agreed possession date. You can file even if the builder has given a new possession date, waiting longer does not improve your position.

How long does a RERA complaint take in Delhi?

RERA Delhi is significantly faster than civil court litigation. A typical complaint reaches a hearing within 2–4 months of filing and most complaints are adjudicated within 6–12 months of admission. Enforcement of the order, if the builder complies voluntarily, can take an additional 1–3 months. If the builder contests or delays enforcement, proceedings before the Appellate Tribunal or Delhi High Court may extend the timeline.

Can I claim both possession and compensation under RERA?

You can claim an order for delivery of possession along with compensation (interest) for the delay period from the agreed possession date to the date of actual delivery. Alternatively, if the delay is substantial and you no longer want the property, you can claim a full refund with interest from the date of each payment. You cannot claim both possession and a full refund, you must choose. We advise on which option is more advantageous given the builder’s current project status and your financial position.

What documents do I need to file a RERA complaint in Delhi?

The key documents are the builder-buyer agreement, all payment receipts showing amounts paid and dates, the RERA registration certificate for the project (available on the RERA Delhi portal), any correspondence with the builder about possession, and a demand notice if you have already sent one. We review these documents, calculate the compensation or refund due, and prepare the complaint for filing before RERA Delhi.
